These Terms and Conditions (“Terms”, “Agreement”) govern the access to and use of the website of Better Earth India Charitable Trust (“Trust”, “we”, “us”, or “our”), a charitable trust registered under the laws of India, including but not limited to all content, services, functionality, donations, and related activities made available through the website (the “Site”).
By accessing, browsing, or using this Site, you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use or access the Site.
1. Definitions

• “Trust” refers to Better Earth India Charitable Trust, including its trustees, employees, volunteers, associates, representatives, and affiliates.

• “Site” refers to the official website of the Trust hosted on Wix or any other hosting platform used by the Trust.

• “User” refers to any natural or legal person accessing or using the Site, whether directly or indirectly.

• “Donor” refers to any individual or entity making a voluntary monetary or non-monetary contribution to the Trust.

• “Volunteers/Trustees/Associates” refers to individuals engaged in furthering the objectives of the Trust on a voluntary or honorary basis.

2. Acceptance of Terms
By using this Site, you expressly agree to comply with these Terms and all applicable laws and regulations of India. If you use this Site on behalf of an organization, you represent and warrant that you are authorized to accept these Terms on such organization’s behalf.
3. Purpose of the Site
The Site serves as an online platform for:

• Disseminating information about the Trust, its charitable programs, campaigns, and initiatives.

• Enabling Users to make donations, contributions, or payments in furtherance of the Trust’s objects.

4. Intellectual Property Rights

5. Donations, Payments, and Refund Policy

• All donations to the Trust are voluntary, irrevocable, and non-refundable, except where required by applicable law.

• The Trust does not guarantee any commercial return, financial benefit, or tax exemption beyond what is legally available under Indian law.

• Payments processed through third-party gateways (such as payment processors integrated into the Site) are subject to their terms and conditions. The Trust assumes no liability for errors, security breaches, or losses resulting from third-party payment services.

• Donors are responsible for ensuring accuracy in providing details such as name, contact information, and donation amounts.

6. Limitation of Liability
To the fullest extent permitted by applicable law:

• The Trust, its trustees, volunteers, officers, employees, or associates shall not be liable for any damages (direct, indirect, incidental, consequential, punitive, or exemplary) arising from or in connection with:

  • The use of or inability to use the Site;

  • Errors, omissions, interruptions, delays, or defects in the Site or its content;

8. Volunteer and Trustee Protections

• Volunteers, trustees, and associates engaged in activities for or on behalf of the Trust do so in good faith, on a voluntary or honorary basis, and shall not bear personal liability for any claims, damages, or losses arising out of such activities.

• The Trust shall not be liable for any injury, accident, or loss incurred by volunteers or participants in Trust-related activities, except as required by law.

• Users engaging with Trust activities (whether physical or digital) do so at their own risk and responsibility.

9. Privacy and Data Protection

• The Trust respects User privacy and collects, processes, and stores personal data strictly in accordance with applicable data protection laws.

• Users consent to the collection, use, and processing of their personal data for purposes connected to the Trust’s objectives, including communications, fundraising, and compliance.

• The Trust will not sell, rent, or trade User information to third parties, except where required by law or necessary for carrying out its charitable functions.

10. Third-Party Content and Links

• The Site may contain links to external websites or resources operated by third parties. These links are provided solely for informational and convenience purposes.

• The Trust does not endorse, control, or assume responsibility for any third-party content, websites, or services.

• Users acknowledge and agree that access to third-party sites is entirely at their own risk.

11. Warranties and Disclaimers

• The Site is provided on an “as is” and “as available” basis without any warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, non-infringement, or availability.

• The Trust does not warrant that the Site will be uninterrupted, secure, error-free, or free from viruses or harmful components.

• No information, advice, or content obtained through the Site shall create any warranty or representation not expressly stated in these Terms.

12. Termination of Access
The Trust reserves the right, at its sole discretion, to restrict, suspend, or terminate any User’s access to the Site at any time without notice or liability, for conduct that the Trust believes violates these Terms or is harmful to the Trust, its interests, or other Users.
13. Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India.
